I want to leave my husband we own our house jointly and he’s made it very clear he won’t leave. He’s quite nasty to our son and my son who is 12 has asked if we can move out. I’ve applied for 3 houses and been declined due to my wages not meeting the 30 x rent per month all the rent is £1100 plus on every thing so I can’t afford it. UC have said they will help but the agencies will only accept people already claiming it.. I’m not as im still in our family home. I have no where to go at all and I have 2 children. I don’t know what else to do. I don’t want to do a refuge or woman’s aid as it just scares me. Tia x

Have you got family or friends you can stay with for a bit? Make yourself homeless . Council should help x
Do not leave the house. You own it jointly. Get a family lawyer and start divorce proceedings asap. Also log everything he’s done to your son. Report the abuse so there is a record of it.
Can you not get social serviced and apply for legal aid and see if you can stay in the house under a mesher agreement through court ..if not he will have to buy you out x
Get social services involved regarding son and his dad, they may help to sort your situation out especially if you’re wanting to leave as you’ll be classed as vulnerable xx
If he wont sell then he has to buy you out personally i would speak to a solicitor and see where you stand, then you could use that for a deposit on ur own place if its hard finding somewhere x
If you divorce you’ll get the house
I was in the same situation, I left the family home 😞 it’s hurts so bad. But UC stepped up and helped massively. Speak directly to them, involve citizens advice if needed.
I was in the exact situation and im doing good now 3 years down the line. Good luck X
Also with uc as owned house nit living in youd need to ask for house to be disaagred for 6 months and if ex refuses to sell ask for extnsion
If he won’t sell the house would be consider buying you out? That would give you a lump sum of money to set up elsewhere. He can’t just expect you to walk away from your share. You can also apply to the Court for an “Order for division and sale” which would effectively force him to sell up.
Make a UC claim as a single person, if your seperated but still living together in the same property you can still claim
