Cut a long story short, partner of 25 years was unfaithful, we have spoken and split as neither of us wants to carry on the relationship, however we have 4 children, aged from 13 to 3. We both have a house and both on the mortgage, I was happy to sell up and split the equity but I am struggling massively to get a decent enough mortgage for me and the kids, even with a 60k deposit. We both earn the same (35k) so not high earners. What are my rights, can u stay here with the children? Until youngest is 18? I spoke to mh mortgage advisor and i cannot afford to buy hjm out. The only thing I can think of is to remortgage next year when it comes up, give him his share (60k) and pay the mortgage on my own, which I can afford, despite what the bank says. However he would still be named on the mortgage ans title deeds. He is a good man (normally!) So he wouldnt do me over in regards to the house, but has anyone got any advice I’m getting very stressed worrying about where we will live!

He will fuck you over the minute he gets a new girlfriend that he cant afford. He needs to sign papers to say you can live in it till the kids are 18 and then you buy him out. You both pay the mortgage and if he doesn’t the house automatically becomes your house.
You never know Mr Right maybe able to help you in the future , to buy him out faster.
He cheated, he does not get rewarded with a pay out so he can move on and your left with no way to fix your roof if it dies on you. You need the remortgage money for that stuff later on .
Why dont you apply for a shared equity scheme lets a government or lender chip in a percentage of the purchase price, holding a matching share of the property’s value until you sell or buy them out.

Go to a family lawyer, when married you can legally stay in the home as it’s joint mortgage and the home is both of yours, in the best interest of children once the youngest turns 18 then the home has to be sold and split the equity equally and both buy or rent whatever’s best at the time. He legally has to still pay his way mortgage etc or the house will be repossessed in due course.
Theres lots you can find online and seek the best advice. They also take into consideration reasons for the split and if it’s his fault then you go in favour.
